1. Agreement to Terms

By accessing or using MyClaimsBrain (the "Service"), you agree to be bound by these Terms of Use ("Terms"). The Service is operated by KeenAI Ventures LLC ("Company," "we," "us," or "our"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

MyClaimsBrain provides AI-powered educational guidance on home and auto insurance topics, including coverage questions, FNOL (First Notice of Loss) preparation, and claim filing decisions. The Service is for educational and informational purposes only and does not constitute insurance advice, legal advice, or a substitute for consultation with a licensed insurance professional or attorney. 3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

4. Accounts & Membership

Certain features of the Service require a paid membership. By purchasing a membership:

• You authorize us to charge your payment method for the selected plan (Annual at $40.00/year).
• Memberships are non-transferable and for personal use only.
• You are responsible for maintaining the confidentiality of your account credentials.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Payments & Refunds

All payments are processed by Stripe, Inc. Prices are listed in USD and are subject to change with notice. Our refund policy is as follows:

• Annual membership: If you experience a technical issue preventing access to the Service, contact us within 7 days of purchase at [email protected] for a resolution.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Share, resell, or redistribute your membership access or downloaded materials.
• Attempt to reverse-engineer, scrape, or extract the AI system's underlying content.
• Submit false or misleading information in call request forms.
• Use the Service to harass, defraud, or harm others.

7. Intellectual Property

All content, guides, checklists, AI responses, and materials provided through the Service are the intellectual property of KeenAI Ventures LLC. You are granted a limited, non-exclusive, non-transferable license to use the materials for your personal insurance-related purposes. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI RESPONSES WILL BE ACCURATE OR COMPLETE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KEENAI VENTURES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO RELIANCE ON AI GUIDANCE IN MAKING INSURANCE CLAIM DECISIONS. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
